Pursuant to Must Sell Right Now’s Privacy Policy for mustsellrightnow.com Must Sell Right Now may at will, report you to the U.S Department of Housing and Urban Development or other appropriate authorities if you submit or post, or attempt to submit or post, information that that discriminates in the sale or financing of your property on the basis of race, color, religion, sex, disability, familial status or national origin. In doing so you agree and accept that Must Sell Right Now has the right to provide any information given to Must Sell Right Now, mustsellrightnow.com by you will be provided to any and all policing authorities that may choose to investigate the case against you.

If you transmit, submit or post information to mustsellrightnow.com (including, without limitation, your name, contact phone number, property location, style, features, selling price and description, and any pictures and virtual tours of your property), (real or otherwise) you willingly and automatically grant Must Sell Right Now, mustsellrightnow.com the worldwide, fully-paid, royalty-free, exclusive right and license to use, copy, format, adapt, publish and/or incorporate at will, any or all such information in any media whatsoever, including, without limitation, the content of any posting or uploads.  

 

Must Sell Right Now, may, in its sole discretion, edit, refuse to post or remove any information you transmit, submit or post to mustsellrightnow.com without any additional prior or post notice at its sole discretion.

The proprietary information, data and content viewable on, contained in, or down loadable from, mustsellrightnow.com (collectively, the “Content”), including, without limitation, all text, resources, graphics, descriptions, charts, pictures, photographs, images and line art, are copyrighted by, or otherwise licensed to, Must Sell Right Now.  If you provide Must Sell Right Now with, or Must Sell Right Now, mustsellrightnow.com obtains or otherwise provides,  information on your property, including, without limitation, your name, contact phone number, property location, style, features, selling price and description, and any pictures and virtual tours of your property, real or otherwise, you automatically grant Must Sell Right Now, mustsellrightnow.com the worldwide, fully-paid, royalty-free, exclusive right and license to use, copy, format, alter, adapt, publish and/or incorporate any or all such information in any media whatsoever, including, without limitation, the Content.

 

Must Sell Right Now, also owns a copyright of a collective work in the selection, coordination, arrangement, presentation, display and enhancement of the content.  Viewing, reading, printing, downloading or otherwise using the Content in accordance with this Agreement does not entitle you to any ownership or intellectual property rights to the Content. You may not remove or alter any Must Sell Right Now logo from anything you download from the website.

 

You shall be solely responsible for any damage resulting from your infringement of Must Sell Right Now‘s intellectual property rights regarding the “Must Sell Right Now” and “www.mustsellrightnow.com” names, the Must Sell Right Now and mustsellrightnow.com logos, characters, and graphics, and/or the Content, and/or any other harm or expense incurred by Must Sell Right Now as a direct or indirect result of your copying, distributing, redistributing, transmitting, publishing or using the same for purposes that are contrary to the terms and conditions of this Agreement. Access and Interference:

Much of the information on this website is updated on a real time basis and is proprietary or is licensed to Must Sell Right Now by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the website for any purpose without our express written permission. Equipment and Related Costs:

You may find it possible to access the Internet and therefore your account at your local library or Internet cafe’s if you cannot do so from your own system. NO refunds for failure to maintain or cancel your ongoing service contract.

 

Cancellations & Reoccurring Services:

It is your responsibility to cancel your reoccurring listing services and therefore your reoccurring billing should any apply, before they are re-billed. If your services that have reoccurring billings are not canceled, by you prior to the first second of the first day of the new billing cycle your billing will be automatic and will be for the entire month. Should you wish to cancel your reoccurring services you should do so prior to the beginning of the next billing cycle. No credit pro-rations are available for non-compliance and all services with Must Sell Right Now, mustsellrightnow.com are paid for in advance, without exception.

 

Your reoccurring billing cycle with Must Sell Right Now, mustsellrightnow.com will be from month to month for listing services. For example, if you list your property, real or otherwise with Must Sell Right Now, mustsellrightnow.com on the 15th of the month your billing cycle will be the 15th of each month, regardless of how many days are actually in each month. Your reoccurring billing will be automatically charged on the 15th of each month until you cancel the listing for all the reoccurring billing services. If you do not cancel your reoccurring services on or by the 14th you will be automatically re-billed in advance for the then current coming month’s service on the 15th. If your billing cycle starts on the 31st and there are only 30 days in the coming months your cycle will renew on the 30th day, or the last calendar day of the month.  

 

All month to month services (if any) will be all paid in advance to Must Sell Right Now, mustsellrightnow.com for the month in which the service is actually used. If services expire and you choose to continue at a later date you may have to re-list and upload all pertinent information, however you may contact This e-mail address is being protected from spambots. You need JavaScript enabled to view it to determine if we may be able to assist you. You are not entitled to a refund partial or otherwise, for late cancellations of any listing plan for any reason. It is your responsibility to cancel the listing BEFORE it expires. It is your sole responsibility to ensure your listing has been canceled to avoid further re-billing.     

 

Third Party Links:

There may be links provided by Must Sell Right Now on mustsellrightnow.com to other websites belonging to Must Sell Right Now’s advertisers, business partners, affiliates and other third parties.  Such links do not constitute an endorsement by Must Sell Right Now of those websites, nor the products or services listed on those websites.  Must Sell Right Now is not responsible for the activities or policies, procedures, problems, errors and or omissions, control or use of those websites. By doing so you waive any rights you have for your services and any prorated refund whatsoever of any previously received charges for services, and your current listing may be immediately canceled, deleted or edited at Must Sell Right Now’s sole discretion.

 

Must Sell Right Now, mustsellrightnow.com reserves the right to immediately cancel your listing, retain your fees previously collected, expenditures, and cancel your listing and services and right to use Must Sell Right Now’s services in the future. If you determine you need to post a link for your subscription to perform as you think it should you should first get permission in writing from Must Sell Right Now, which permission may be withheld at the sole discretion of Must Sell Right Now. 

 

You agree to not include or post any link or hot link (active or not) to any other website for any purpose in your ad listing. If you violate or fail to comply with this policy and specific term of use, you agree to waive any and all rights afforded to you, or you may have and agree to reimburse Must Sell Right Now 200% of its legal fees in addition to $25,000 in additional liquidated damages for/per each single violation of this policy. You agree Must Sell Right Now may place a legal lien against your property, real or otherwise until the fines and penalties are paid in full. Must Sell Right Now will strongly pursue to its maximum legal limits each violation of this policy. This paragraph in no way shall limit the compensation of and for damages to Must Sell Right Now.

Must Sell Right Now, makes no claim of warranty, usability, quality, correctness of Content contained in the listing or if that property is of any particular use or value at all. It is your responsibility to perform your own due diligence in any purchase you make. Must Sell Right Now is providing this service as an additional service to our clients and therefore cannot be responsible for the validity or correctness of the Content contained in those listings. NSF Charges, Chargeback’s or Declined Payments:

Must Sell Right Now, & mustsellright.com, provide a service that is both easy to use and affordable. In doing so Must Sell Right Now, must have a strong NSF policy. It is our intent to provide a useful service with value for a reasonable fee. However if your credit card company or bank deny or return a charge unpaid, for any reason, including but not limited to contest, Must Sell Right Now are also charged fees for the same return, (currently $25.00, subject to change) and therefore will pass that fee back to you for payment with any and all additional expenditures incurred by Must Sell Right Now in the collection of those expenses. These charge back and NSF fees will include but are not limited to actual cost by Must Sell Right Now or mustsellrightnow.com. By your use of Must Sell Right Now, mustsellrightnow.com ‘s services you are hereby agreeing in advance to reimburse Must Sell Right Now for any and all additional expenditures, regardless of nature related to the legal fees, collection or procurement of funds due from you, to Must Sell Right Now.

 

Address Changes:

When you use Must Sell Right Now, mustsellrightnow.com ‘s services you agree to pay by credit card, debit card or check, check by phone, you agree to provide Must Sell Right Now, mustsellrightnow.com, with the correct phone number and mailing address for your payment method. This mailing address must be the same one that is on file with the payment method source. Must Sell Right Now will perform an address check on the payment type provided to verify ownership of the payment type you provide, therefore the address you provide must be the exact same including but not limited to the zip code, as the one on file with your Credit Card Company or bank.

 

Please make note, it is your sole responsibility to update your billing address with Must Sell Right Now, should you move and change your address on the credit card. Your Failure to update your billing address may add additional charges from your bank and or for non-payment for services by Must Sell Right Now. By using, Must Sell Right now, mustsellrightnow.com ‘s services you agree to reimburse Must Sell Right Now for any and all chargeback fees, and or collection expenses incurred in the process of procuring payment for our services, including but not limited to, collection and or legal fees. In such an event, Must Sell Right Now may, at its own discretion cancel or remove your listing(s) from public view without recourse or any additional notice. If your payment is returned for any reason and your services are canceled for non payment, any special, promotion or other discount your may have had will be forfeited and if applicable the new fees, or charges will apply to relisting or renewals.   

 

In an effort to redefine customer service, please contact Must Sell Right Now prior to any charges being made and then reversed or before using a payment method that may be returned NSF or be declined for any reason. Must Sell Right Now, believes our clients and advertisers are very important to our success, and we will make every effort to resolve any issue and to provide reasonable solutions to these and other discrepancies. Disputes: 

From time to time there may come a time when you may have a dispute with Must Sell Right Now, that needs resolution, or need assistance in trying to resolve a potential dispute. Limitations on Must Sell Right Now’s Liability:

Must Sell Right Now, and mustsellrightnow.com shall in no event be responsible to, or liable to, you, or any third party, whether in contract, warranty, tort (including but not limited to negligence) or otherwise, for any damages, including, but not limited to, special, incidental, indirect or consequential damages that include, but are not limited to, damages for any loss of profit, potential loss of profit, lost cost of opportunity, lost time, revenue or business, as a direct or indirect result of: (1) your breach or violation of the terms and conditions of this Agreement; (2) your access and use of mustsellrightnow.com (3) your inability to access or use mustsellrightnow.com for any reason, even if, but not limited to, the website is being serviced, updated or may be down or offline for any reason whatsoever, including but not limited to acts of God; (4) your downloading of any of the Content for your use; (5) your reliance upon or use of the Content; or (6) your understanding or misunderstanding of / or the accuracy of any or all listings posted whether by Must Sell Right Now, mustsellrightnow.com , its clients, vendors, customers or advertisers.

 

You agree that Must Sell Right Now, musetsellrightnow.com, and including but not limited to all of its employees, directors, stockholders, family members or heirs, affiliates, content providers, architects, designers, hosts, shall not be liable for any direct, indirect, consequential, special, incidental or punitive damages, including but not limited to, without limitation, damages related to loss of data, loss of good will, profits, proceeds, or commercial opportunities, unauthorized access to or alteration of your transmissions or data, the services or any errors or omissions in the services or related content, completeness, currentness  or correctness of any document provided by, even if advised of the possibility of such damages. Indemnification of Must Sell Right Now:

You shall defend, indemnify and hold harmless any and all but not limited to, Must Sell Right Now, mustsellrightnow.com and its officers, owners, directors, shareholders, heirs, managers, employees, independent contractors, agents, representatives and affiliates from and against all claims and expenses, including, but not limited to, attorneys’ fees, arising out of, or attributable to: (1) any breach or violation of this Agreement by you; (2) your failure to provide accurate, complete and current personal information requested pursuant to registration, payment of services, or the listing of your property, real or otherwise; (3) your ability to access or use of mustsellrightnow.com; (4) access or use of mustsellrightnow.com under any email address (if provided), username or password that may be issued to you; and or (5) any misunderstanding you may have and or do not understand about these terms and conditions and fail to inquire about prior to use or services provided by Must Sell Right Now, mustsellrightnow.com or it affiliate websites.

 

 

Third Party Rights under this Agreement:

This Agreement is for the benefit of Must Sell Right Now and its affiliates, each of which shall have the right to enforce and assert the terms and conditions of this Agreement directly against you on behalf of Must Sell Right Now, or mustsellrightnow.com, or its affiliate companies.

 

Amendments of this Agreement:

Must Sell Right Now, reserves the right to amend and or update this Agreement at any time in its sole discretion and without prior or post notice.  Changes, revisions, updates or deletions with regard to this Agreement shall be effective immediately upon their inclusion in, or deletion from, this Agreement, and the posting of the same in this Agreement on mustsellrightnow.com.  

 

You are encouraged as a condition of your use of mustsellrightnow.com’s website and or services to revisit this Agreement from time to time in order to review any changes or updates that may have been made.  Your continued access and use of mustsellrightnow.com following the posting of any such changes shall automatically be deemed accepted to and your agreement of the same without objection or recourse to or upon Must Sell Right Now.

 

Must Sell Right Now's Remedies:

Governing Law; Jurisdiction and Venue:
